Child Custody and Visitation
At the Christy & Keith Family Law Group, we have the experience and know-how to handle and counsel families through any family issues that involve the custody or visitation of children. We know that nothing is as important to you as your children, and we will treat your case with the utmost sensitivity and respect in all custody and visitation matters.
The standard that courts will use in determining custody is the “best interests” of the child. There are a variety of factors that courts will take into consideration in making their determination. While courts will first look to granting joint custody to both parents, each case is handled on a case-by-case basis with the best interests of the child governing the outcome.
Our qualified and experienced attorneys are knowledgeable about the family court system and can help you evaluate your situation and build a solid case to present to the judge. We work closely with parents to counsel them through the process and to the extent possible, we seek to reach an amicable resolution that all parties can agree upon.
During divorce proceedings or when parents otherwise separate, visitation and the amount of time that parents are allowed to spend with their children is a very highly debated issue. Visitation is the time that a child spends with his or her parents. California law recognizes the importance of allowing children to spend time with parents and favors frequent and continuing contact with both parents. Unless there is evidence that parenting time would be detrimental to the child’s best interests, visitation will generally be granted.
California courts encourage parents to come to an agreement concerning a visitation schedule. If the parents can agree on a schedule, the courts will generally uphold the agreement, unless the court determines that it contrary to best interests of the child. If the parties, however, cannot agree, the court will determine the matter and will issue an order specifying when the child will spend time with the non-custodial parent.
Attorneys at the Christy & Keith Family Law Group have extensive experience representing parents in California courts and are familiar with the process and the factors that local judges will take into consideration in determining custody and visitation. We will work to protect your rights as a parent and promote the best interests of your children.
